GUESS? PH PRIVACY NOTICE

We at CALIFORNIA CLOTHING, INC. (GUESS? PH) respects the privacy rights of all individuals such as their right to be informed, right to access, right to rectification, right to erasure or blocking, right to data portability, right to object, right to lodge a complaint, and right to damages, among other. We are committed to handling personal data responsibly and in accordance with the Republic Act 10173, otherwise known as the Data Privacy Act of 2012, and its pertinent rules and regulations, because everybody’s privacy is important to us. This Privacy Notice is not a consent form but this is GUESS? PHILIPPINES general statement on its data processing activities to notify Data subjects of personal data processed and the purpose and extent of processing. We may further provide other notices at the time of specific activities

A. PERSONAL INFORMATION: We collect personal information such as name, mobile and/or telephone number, email address, gender, birth date, and home or business address. We may likewise collect other information that we believe are relevant to meet the requirements of government authorities and for any other legitimate purposes.

B. PURPOSE AND USE OF COLLECTED INFORMATION:  GUESS? PH collects personal data only when data subjects have voluntarily provided their information and only when we are allowed with their permission to process such data. We use the information for (1) to endorse promotional campaigns and product launches; (2) to process membership for the GUESS? List and GUESS? NOIR programs; (3) to reward customers of Gift-WithPurchase (GWP) Program, or all other promotional activities; (4) to deliver personalized brand campaigns through email or SMS; (5) to conduct analytics for GUESS? PH; and (6) to comply with any legal obligation or any mandate directed by government and/or judicial authorities, among other legitimate purposes. GUESS? PH collects personal information through submission by the data subjects through electronic systems and platforms, e-forms, email, or through physical and/or printed forms, attachments, and other documents required by our stores at the onset of service, transaction or processing.

C. DISCLOSURES WITH CONSENT: We keep all personal data as confidential, provided however that upon voluntary consent of data subjects, their information may be disclosed or transferred to service providers of GUESS? PH, including but not limited to (1) email and text blast providers, (2) external auditors and legal firms, and (3) other service providers that may be appointed by GUESS? PH.

D. DATA RETENTION AND SECURITY MEASURES:  We store the collected personal information via our in-house POS system and through the cloud storage of third-party apps. GUESS? PH ensures that all of the personal data it collected and processed are adequately protected and secured, and this step includes putting the collected data in a secured designated place/room with ample security measures like biometrics and CCTV cameras to prevent their unauthorized access and improper use. Notably, the personal information collected is encrypted with valid credentials required for access from authorized administrators only. Personal data collected and processed are retained by GUESS? PH only for as long as necessary for the fulfillment of the purposes for which the data was obtained or for the establishment, exercise or defense of legal claims, or for legitimate business purpose, or as provided by existing laws.
